The Order of the Provincial Court of Pontevedra, Section 3, dated 16 February 2024, upholds the appeal filed by Asigno, and agrees that it is not necessary to prove the debtor's vulnerability in the foreclosure lawsuit on the habitual residence, if the executor does NOT hold the status of large holder.
In this article we analyse article 685 LEC after the entry into force of Law 12/2023, and the requirements that must be met with regard to the accreditation of the debtor's vulnerability in the foreclosure lawsuit on the main residence, in the case of a non-grand holder foreclosing party.
